Google & Gonzales May Tangle in Round Two

“Google may be about to face a second round of subpoenas for search-related information.

“If the U.S. Justice Department is successful in obtaining a week’s worth of search terms from Google, which it demanded as part of an attempt to defend a 1998 Internet pornography law, a second round of subpoenas is shaping up to be far more intrusive.”

Apple Invokes DMCA to Stifle OS X Discussion

“Apple Computer appears to have invoked the Digital Millenium Copyright Act to stop the dissemination of methods allowing Mac OS X to run on chips from Intel and Advanced Micro Devices.

“The chatter at the OSx86 Project was stifled Friday after the forum was served with a notice under the DMCA, according to a posting on the site.”

Amazon.com Rumored Ready To Challenge iTunes

“In recent years, Amazon.com Inc. chief executive Jeff Bezos has explained his company’s deliberately paced approach to the digital-music business by saying he wants to avoid simply imitating the dominant player in the field, Apple Computer Inc.’s iTunes Music Store.

“Now Amazon, the world’s No. 1 online retailer, is in advanced talks with the four global music companies about a digital-music service with a range of features designed to set it apart. Among them: Amazon-branded portable music players, designed and built for the retailer, and a subscription service that would deeply discount and preload those devices with songs, not unlike mobile phones that are included with subscription plans as part of the deal.

“Music executives privately welcome Amazon’s plans, which they see as one of the only credible challenges to Apple’s hegemony in both digital music and portable players. Now the question is whether Amazon’s massive customer base is enough to offset a long delay in entering the online music business.”

Publishers Should Praise Google Book Search

“Google’s new Book Search promises to save writers’ and publishers’ asses by putting their books into the index of works that are visible to searchers who get all their information from the Internet. In response, publishers and writers are suing Google, claiming that this ass-saving is in fact a copyright violation.

“When you look a little closer, though, you see that the writer/publisher objections to Google amount to nothing more than rent-seeking: an attempt to use legal threats to milk Google for some of the money it will make by providing this vital service to us ink-stained scribblers.”

Strong Critique of Google Video DRM

“With the introduction of its new copy-restriction video service, Google has diverged from its corporate ethos. For the first time in the company’s history, it has released a product that is designed to fill the needs of someone other than Google’s users.

“The question is, why has Google done this? There’s no Google customer who woke up this morning looking for a way to do less with her video. … That’s not to say that there’s nothing problematic about getting your video through Google this way. But the problems of the inability of the entertainment industry to adapt to the Internet are the entertainment industry’s problems, not Google’s. Google’s really good at adapting to the Internet — that’s why it’s capitalized at $100 billion while the whole of Hollywood only turns over $60 billion a year.

“But once Google starts brokering the relationship between Hollywood and their audience, this becomes Google’s problem too, which means that all the absurd, business-punishing avenues pursued by Hollywood are now Google’s business, as well.”

Disney Follows Soderbergh, Shunning Staggered Releases

“Buoyed by its success selling ABC television shows online, Walt Disney Co. plans to revive an experimental service today that beams movies into customers’ homes.

“Disney and its partners — Cisco Systems Inc. and chip maker Intel Corp. — are relaunching MovieBeam as the market for downloadable video is picking up. Disney was among the first companies to sell shows through Apple Computer Inc.’s iTunes Music Store.

“But, analysts said, MovieBeam is anything but a sure bet.”
